Leuk gevonden die getallen over de schikking maar ze zijn wel van onbetrouwbaar Folha, die eerst met 1,7 miljard $ kwam ofwel rond 6 miljard Br Real. Ik hou het op MoU. Maar elke info die wat meer waarheid lijkt prijs te geven is natuurlijk welkom, dat is het avontuur dat beleggen heet.

Het was 1.7 mijard Braz Real wat in Folha stond, door Google translate valt het Real teken weg.

toch een mei-artikel blijkbaar over SBm. maar ik geen lid daar. hoor 8ik nog wel eens, van de vorige 5 artikelen alleen maar niet-terechte verdachtmakingen en telegraaf-stijl opmerkingen met een vraagteken of het wel zo is. Bizar dat je Quote als een bron citeert. Een SBM-belegger weet bronnen met een goede en stabiele productie beter in te schatten ;-) Nee, het Folha-bedrag is nergens elders in de Braziliaanse pers herhaald, en was dan ook duidelijk een kwakkel om de koers de nek om te wringen. Je "CGU-bedrag" dateert ook al van november vorig jaar, en is evenmin nog actueel. Met vandaag de Petrobras-cijfers in handen, die het CGU als leidraad voor de schadevergoeding zal gebruiken, ziet het er immers naar uit dat SBM geen extra vergoeding zal moeten betalen dan wat reeds in Nederland voorzien werd. Maar dat had je hierboven ook al uitgebreid kunnen nalezen :-)

Het lijkt erop dat Petrobras meer prioriteit geeft aan de afhandeling van de Lava Jato-zaken, daar valt immers ook meer geld terug te vorderen.

The decision served to revive the talks with company representatives. Finally, the release of Petrobras’s financial statements also facilitated the resumption of dialogue between authorities and companies. At the CGU, five companies manifested interest in cooperating with the negotiations and are discussing possible leniency agreements. They are: OAS, Galvão Engenharia, SOG Óleo e Gás, Engevix and Dutch firm SBM Offshore. Now, they are negotiating the terms of these agreements. These talks are been held having four CGU requirements as basis. First, the company must admit it wrongdoing. Renowned law firms are developing the adoption of these programs, which set good practices inside the corporate structure of organizations in order to prevent future scandals such as Car Wash.The talks with the companies formally have 180 days to be concluded, extendable by an equal period. Until early April, the CGU expected to sign agreements in December. Now, it already sees the prospect of signing leniency agreements before that, due such factors as proximity of justice rulings, favorable TCU decision, release of Petrobras earnings and resumption of negotiations. Banks don’t need companies to have these signed agreements in order to extend loans that can allow the firms involved in the investigation to resume projects. Ne bis in idem (="niet twee keer voor hetzelfde") geldt dit ook niet in de verhouding SBM/Brazilie? Immers in Nederland heft SBM een boete betaald en het berekende onrechtmatig verkrgen winstdeel m.b.t tot het smeergeld. Waarom zou SBM dan nog een keer (veel) betalen aan Brazilie? ik schreef al ergens dat SBM nu last heeft van de wet op de remmende voorsprong, als eerst kwam SBM in de openbaarheid en zal zeer waarschijnlij kals eerste een overeenkomst tekenen, deze ovk is natuurlijk een ijkpunt voor de andere zaken en hier heft brazili eeen belang, anderzijds is het ook Brazilie's belanf SBM weer volop te laten met tenderen teneinde technische kwalitiet en prijs cponcurrentie op pijl te houden, als de ovk getekend wordt vleigt de koers omhoog!
Inderdaad, SBM moet niet twee keer dezelfde schade vergoeden, geldding. Dit lijkt echter niet mogelijk via het principe van het 'ne bis in idem'. Dat is wel als rechtsprincipe aanvaard in het Braziliaanse recht voor eigen beslissingen, maar of Brazilië zich ook gebonden acht aan beslissingen of schikkingen die plaats vonden in het buitenland is een andere vraag. Onrechtstreeks wordt het probleem echter opgelost in de mate dat de schikking in Nederland ongeveer 137 mio $ omvat als terugneming van wederrechtelijk verkregen voordelen in Brazilië. Wanneer er nog een vergoeding in Brazilië betaald zou moeten worden, wordt deze op basis van het Nederlandse Strafwetboek in mindering gebracht op wat in Nederland betaald moet worden. Toevallig moeten twee schijven van het Nederlandse schikkingsbedrag (elk 70 mio $) immers pas einde 2015 en einde 2016 betaald worden :-)
Bendine (CEO Petrobras) is alvast ook volledig gewonnen voor schikkingen en ziet de jaarcijfers als indicatie van een schadevergoedingsplafond. Ook het Braziliaanse OM spreekt nu van 2,1 mia $ aan totaalbedrag aan smeergeld in de Lava Jato zaak. Belangrijk, want het volgt hiermee de conservatieve inschatting door Petrobras van haar schade. En aanvaardt dus de uitgangspunten van Petrobras als valabel voor de beoordeling van de schikking (OM wordt hierbij gehoord, naast het TCU). Er waren voor de CGU twee redenen om geen gevolg te geven aan de informatie die Taylor haar bezorgde: enerzijds de twijfels over het rechtmatig karakter ervan, maar anderzijds dat men eigenlijk geen nieuws erin vond, rekening houdend met de stappen die SBM zelf had gezet, en de schikking die in Nederland was bereikt. Dat viel ook op bij het bekijken en beluisteren van de e-mails en geluidsfragmenten op de Quote-site die vorige week moesten bewijzen hoe het bij SBM eraan toe ging. Very “much ado about nothing”. Ja, inderdaad zou het kunnen dat Faerman betaald heeft voor informatie. Maar of dat zeker is? Nee, zelfs dat bleek niet onomstotelijk uit de e-mails en conversatiefragmenten. Correct, Chela, in Nederland. Ik had de situatie in Brazilië in gedachten, waar ik nooit van enig contact met het OM gehoord heb.
