Biden Targets Crypto Tax Evaders in Global Data-Sharing Pitch June 2, 2021, 9:07 PM Administration proposes sharing data with foreign governments Proposal is part of broader cryptocurrency tax-evasion push The Biden administration has proposed requiring the collection of data on foreign cryptocurrency investors active in the U.S., aiming to bolster international cooperation to help in a broader crackdown on tax evasion. The Treasury Department, in its “Greenbook” of revenue proposals released last Friday, proposed a requirement for cryptocurrency brokers, such as exchanges and hosted-wallet providers, to provide information to the IRS on foreign individuals indirectly holding accounts with them. “They clearly feel that right now there’s a blind spot for foreign owners,” said Jorge Castro, a tax attorney at Miller & Chevalier Chartered who previously worked at the IRS and as a Democratic tax counsel on Capitol Hill. The proposal addresses “certain passive entities and their substantial foreign owners,” the Treasury said. The U.S. could then provide that information to foreign governments and, in exchange, receive information on any U.S. individuals concealing cryptocurrency assets and dodging their U.S. tax liabilities by using offshore exchanges and wallet providers. The move, which would require congressional legislation, is part of a campaign by President Joe Biden’s administration to strengthen tax enforcement to help pay for trillions of dollars of proposed longer-term spending programs. It also coincides with the Treasury’s engagement with counterparts around the world to set a global minimum tax for corporations. Widening Concerns Officials say cryptocurrencies have served as a significant contributor to the growing tax gap -- the difference between taxes owed and actually paid on time -- that Internal Revenue Service Commissioner Charles Rettig has estimated may exceed $1 trillion a year. There may also be a cyber-security element. White House Press Secretary Jen Psaki said Wednesday that expanding analysis of cryptocurrencies is one of the steps the administration is taking to help curb cyber attacks. The Greenbook proposal would be a continuation of information exchanges the U.S. already conducts with foreign governments to uncover U.S. citizens hiding assets offshore in undisclosed foreign bank accounts, said Charles Kolstad, a partner at international law firm Withers. The Blockchain Association, whose members include trading platforms that would be subject to the new reporting requirement, declined to comment. Cryptocurrency exchanges Kraken and Coinbase didn’t return requests for comment. Read More: Treasury Seeks Crypto Transfers Over $10,000 Reported to IRS The proposal to require reporting on foreign owners seems aimed at those who set up shell companies in the U.S. to transact in cryptocurrency, said former IRS Chief Counsel Michael Desmond, who’s now a partner at Gibson, Dunn & Crutcher LLP. The IRS’s Criminal Investigation division has already been working with agencies in other countries -- Australia, Canada, the U.K. and Netherlands -- to pursue global tax cheats, including those using cryptocurrency. To the extent permitted under each country’s laws, the agencies share information and coordinate efforts. “The global nature of the crypto market offers opportunities for U.S. taxpayers to conceal assets and taxable income by using offshore crypto exchanges and wallet providers,” the Greenbook proposal said. The Treasury, prior to the start of this year, was already working on proposed regulations under existing law that would require cryptocurrency brokers to report certain information to the IRS, including the identities of their customers and the gross proceeds from sales. Account Flows The Greenbook suggests that project can still move forward through the regulatory process, but the new requirement on indirect foreign investors will need to be added legislatively, according to Lisa Zarlenga, a partner at Steptoe & Johnson LLP and former Treasury tax legislative counsel. The Biden administration would also need legislation to enact its broader proposal to require financial account reporting by banks and other financial institutions, including cryptocurrency exchanges. The Greenbook provides more details on that provision, which was previewed in prior outlines released by the administration. Under the proposal, financial institutions would have to report gross account inflows and outflows with a breakdown for physical cash, transactions with a foreign account and transfers to and from another account with the same owner. The requirement would apply to all business and personal accounts except those below a $600 threshold. In addition, businesses that receive transfers of cryptocurrency valued at more than $10,000 would have to report those transactions to the IRS. “They’re really looking to gather as much information on the purchase, sale and movement of digital assets as possible,” said Evan Fox, a director at Marcum LLP. The fact that they’re taking so much interest in cryptocurrency validates the asset class -- which many in the industry see as a good thing, he said. The Biden administration is proposing that all of the new reporting requirements go into effect in 2023, which some tax professionals said may be a fast turnaround for the IRS and private sector.

Arrestaties voor grootschalige oplichting met crypto’s: verdachte verkocht eigen munten Door ONZE REDACTIE DEVENTER - Een 39-jarige man uit Deventer is onlangs aangehouden op verdenking van grootschalige oplichting met cryptovaluta. De man had zijn eigen digitale ’coins’ in het leven geroepen, adverteerde daarvoor op sociale media en wist zo op gewiekste wijze de prijs op te drijven. Ook een 22-jarige man uit Apeldoorn is opgepakt en een 41-jarige verdachte tijdens een doorzoeking in een loods in Zaandam. „Meer aanhoudingen worden niet uitgesloten”, kondigt de politie aan. In de loods waar agenten op onderzoek uitgingen, stonden verschillende computers die gebruikt worden om cryptomunten te verdienen. De verdachten zijn volgens de politie betrokken bij cryptohandelsplaats Coinhouse.eu. „Als vermoedelijke eigenaar van deze handelsplaats worden zij verdacht van het verduisteren van klanttegoeden en oplichting”, aldus een politieverklaring vrijdag. De mannen wisten digitale munten te creëren en manipuleren. De 39-jarige verdachte uit Deventer maakte veel reclame voor de munt in de hoop dat mensen er zo veel mogelijk geld in zouden investeren. Zo gaat de waarde namelijk omhoog. Op een forum over cryptovaluta en via oproepen op sociale media als Twitter werden de munten aangeprezen. „Door die promotie zorgde de man dat coins door derden werden gekocht (pump). Vervolgens verkocht hij zelf in korte tijd zo veel coins dat deze waardeloos werden (dump). Het doel hiervan is zo veel mogelijk verdienen in een zo kort mogelijke tijd”, meldt de politie in een uitleg. De coins waren online gezet als ERSO, MALC en TulipMania. De politie heeft tijdens het onderzoek onder andere diverse voertuigen ingenomen en beslag gelegd op een woning en meerdere computers en cryptovaluta. POLITIE QR-fraude De man uit Deventer wordt ook verdacht van QR-fraude. Mensen zijn telefonisch benaderd, zogenaamd namens de bank, met de mededeling dat er een internationale betaling klaarstond die kon worden tegengehouden via een verstuurde QR-code. „Ook werd soms gezegd dat de contactgegevens voor de bankrekening waren aangepast, en dat kon worden tegengehouden met een QR-code.” Er zijn ’enkele aangiftes’ binnen van slachtoffers die geld hebben overgemaakt via deze QR-codes. „Steeds meer van ons financiële leven speelt zich online af en dat weten criminelen ook. Criminelen spelen graag in op nieuwe mogelijkheden en het vertrouwen van mensen. Het advies is altijd alert te blijven met linkjes, codes of andere manieren om u ergens naar toe te leiden.” De politie roept mensen op die investeringen hebben gedaan via Coinhouse.eu en denken opgelicht te zijn, zich te melden. Wat betreft het investeren in digitale munten heeft de politie ook een advies. „Ook bij de handel in cryptomunten geldt, als een investering te mooi klinkt om waar te zijn, dan is dat het waarschijnlijk ook.” En verder: Bekijk goed in welke munt je investeert en met wie je zaken doet. The state-backed press agency encourages the public to stay away from the risk and volatile crypto markets to protect their capital. However, the government mouthpiece clearly admits that China does not consider crypto trading to be illegal. Xinhua writes: If only virtual currencies such as Bitcoin are bought and sold as virtual commodities, ordinary people have the freedom to participate in transactions at their own risk. Xinhua added that it would continue to expose projects and platforms that attract retail investors by marketing cryptocurrencies as speculative investments that could allow people to get rich quickly. China Central Television further warned the public how easy it is to create a digital token out of thin air.
