Orphan Designation
The first step in the development of any orphan drug is to obtain designation as an Orphan Medicinal Product (OMP). The Committee for Orphan Medicinal Products (COMP) is the institution specifically created for the designation granting. The COMP is a committee of the larger European medicinal regulatory body, the European Medicines Agency (EMEA).
Criteria
The request for Orphan Medicinal Product designation can be made at any stage of drug development as soon as sufficient scientific evidence can be presented. The research may therefore be pre-clinical (not yet tested on human subjects) or may have reached the human clinical trial phase. Orphan medicinal product designation assigns orphan status based on a defined number of criteria. These can be resumed as:
- The product should be intended to be use for an indication concerning no more than 5 in 10 000 persons in the European Community.
- The disease concerned should be life-threatening, seriously debilitating or a serious and chronic condition.
- There should exist no satisfactory method of diagnosis, prevention or treatment of the condition in question that has been authorized in the European Community; or, if such a method exists, then the medicinal product will confer a significant benefit compared to the existing one.

Let met name op de laatste bijzin:
'or, if such a method exists, then the medicinal product will confer a SIGNIFICANT BENEFIT compared to the existing one'.
In deze bijzin ligt de dood van Increlex als levensvatbaar product besloten. Zodra namelijk ook EMEA goedkeuring verkregen zal zijn voor IPlex zou dit namelijk betekenen dat artsen die nog Increlex voorschrijven de patienten medicijnen (IPlex) met een 'significant benefit' onthouden. Dit is alleen al uit medisch ethische overwegingen niet aanvaardbaar.
Zoals we nu zien betekent Orphan designation dus dat INSM de EMEA COMP commissie in 30 werkdagen ervan heeft overtuigd dat zij potentieel een medicijn kan bieden met 'significant benefit' tov Tercica's Increlex zodra zij heeft voldaan aan de voorwaarden voor goedkeuring voor IPlex.
Kortom: het is een voorwaardelijk vertrouwensvotum door alle leden van de EU van Iplex voor nu 3 verschillende toepassingen!
Nu nog mijn (strikt persoonlijke) mening omtrent een eventuele injunction in het US proces:
Een van de regels voor Orphan designation in de EU en voor de FDA is:
- The disease concerned should be life-threatening, seriously debilitating or a serious and chronic condition.
Dwz dat bij een injunction van IPlex deze mensen veroordeeld zouden worden tot gebruik van Increlex, een medicijn wat dus significante medische nadelen heeft tov IPlex.
Ik persoonlijk verwacht dan ook dat het alleen al daardoor hooguit bij een schadevergoeding zal blijven in het ergste geval.
Het is dus zo dat goedkeuring van IPlex voor groeistoornissen op zich niet de killer is, maar de Orphan Designation tezamen met goedkeuring van IPlex. Dit biedt aan INSM een zeer grote mate van bescherming in het proces.
Kortom: do your DD en er gaat een wereld voor je open...
