Berichten over evoluties in het dossier rond de schikking in Brazilië verdwijnen snel in de gewone poststroom rond SBM. Vandaar het voorstel om specifiek nieuws over dit thema voortaan hier te centraliseren (graag met bronvermelding). We kunnen onmiddellijk beginnen met een bericht van Oglobo, dat bevestigt dat inmiddels afgesproken is dat de TCU de schikkingen die de CGU wilt afsluiten, vooraf zal toetsen. Kwestie kwam eerder deze week al aan de orde. Bedoeling is vooral te komen tot rechtszekerheid voor de betrokken bedrijven, door alle relevante overheden erbij te betrekken, ook het Braziliaanse OM (AGU). Eindelijk! Heb tijdje in dat aandeel gezeten maar heb uiteindelijk met klein winstje verkocht. Had er genoeg van. Dat was qua shorters nog bijna erger dan SBM.

Maar juridisch gezien kan sbm geen boete krijgen aangezien een bedrijf onder de oude regels geen boete kan krijgen maar alleen personen.
Conclusie: Na het sluiten van een leniency agreement is sbm van alle verdere vervolging verlost.
Ja, Jeeves, de vooruitgang zit hem hierin, dat er coördinatie komt tussen de verschillende lopende onderzoeken: CGU, TCU, het Braziliaanse OM én de eventuele aanspraken van Petrobras. En dan betekent een schikking op het niveau van de CGU inderdaad voor deze vier lijnen een oplossing. Hoewel een boete voor de rechtspersoon SBM hierbij juridisch niet mogelijk is, hou ik wel rekening met een beperkte tegemoetkoming voorgesteld als een vergoeding van schade van Petrobras. Daarbij moet nog steeds bedacht worden dat een groot deel van wat in de Nederlandse schikking betaald wordt door SBM, eigenlijk op Brazilië betrekking heeft. Wat er aan onrechtmatige voordelen door SBM is afgestaan, komt dus eigenlijk Brazilië/Petrobras toe, en hoort door de Nederlandse Staat daar overgemaakt te worden. Dat betekent ook dat het in aftrek zou moeten komen van wat SBM eventueel nog in het kader van de Braziliaanse schikking zou gevraagd worden te betalen.

Wederom mijn complimenten, Kopermans. Het wordt eentonig... Dit is idd een positieve ontwikkeling. Het mag hierdoor allemaal wat langer gaan duren, maar wanneer er een overeenkomst is dan zijn we (nou ja, SBM) in één keer van alle onderzoeken verlost. Eerlijk gezegd vond ik het al verontrustend dat er na de veelbesproken schikking met de CGU nog steeds ruimte voor onzekerheid zou zijn. Dat zou de shorters uiteraard fijn in de kaart hebben gespeeld. Van die dreiging zijn we nu verlost.

@IT: Dank, ook @Kostunrix, & graag gedaan, en jullie zijn ook niet de enigen die dachten dat een en ander al lang achter de rug zou zijn... Vandaag is het als bij een 'surplace' in een sprint, waar de wielrenners nauwelijks per centimeter vooruit te branden zijn, maar waar ze ook elk moment kunnen ontploffen als raketten richting de eindmeet ;-)

Complimenten!! Is ook (erg)bemoedigend. Ik zit er redelijk dik in. Enkel om die sprong van 20% te pakken, die komt bij de definitieve schikking. Zie dus dagelijks mijn "bezit" flink schommelen en denk dan..doe ik hier wel goed aan? Dankzij dit uitzoekwerk en het schuiven van de panelen in Brazilie krijg ik ook steeds meer de verwachting, dat het er aan komt. Geef toe, dat dit verder weinig inhoudelijk is.
graag even jullie mening / idee De meeste Petrobras FPSO projecten zijn in het verleden gestart onder Nederlands recht / Petrobras heeft hiervoor separate BV's, destijds gevestigd in Hoofddorp opgericht. Met de 240 Mio schikking met het OM is mijnsinziens alles nu wel geregeld, immers de projecten waren "Nederlands" Enige wat Petrobras nog kan doen is SBM op de blacklist plaatsen en/of "tijdelijk" uitsluiten van tenders, waarbij dit laatste al plaatsvindt. Daarbij opgemerkt dat er ook geen substanciele projecten zijn...(makkelijk uitsluiten..) Daarnaast lijkt het erop dat de hele industrie aan de omkoop praktijken heeft meegedaan, dus wil men in Brazilie / Petrobras verder kan men niet anders dan alleen de betrokken personen te vervolgen en bedrijven (die men hard nodig heeft) buitenschot te laten.www.ft.com/intl/cms/s/0/96152e80-b3ca... Interessant artikel in fd vanavond. Misschien de reden waarom sbm integenstelling tot de olie wel een stijging liet zien vandaag. SBM Offshore Er komen steeds meer details naar buiten over het omkoopschandaal rond het Braziliaanse staatsoliebedrijf Petrobras. Waar afgelopen weekend al bericht werd over mogelijke betrokkenheid van de Britse gasturbinebouwer Rolls-Royce, valt nu de naam van de Japanse bouwer van olieproductie- en opslagschepen Modec. Modec is de grote concurrent van het Nederlandse SBM Offshore. Dat heeft voor zijn deel in de affaire inmiddels een schikking getroffen met de Nederlandse justitie, maar wacht nog wel op de uitkomsten van onderzoeken in Brazilië. Modec zou erkend hebben via een lokale agent steekpenningen te hebben betaald aan medewerkers van Petrobras in ruil voor opdrachten, zo schrijft de Braziliaanse krant Valor Economico op haar website. Volgens de krant zijn er aanwijzingen dat de zaak overeenkomsten vertoont met die van SBM Offshore. Het wordt volgens analist Michel Aupers van Rabobank interessant wat Petrobras doet als Modec, dat in december nog een grote opdracht van Petrobras binnensleepte, zich inderdaad schuldig heeft gemaakt aan omkoping. Vorig jaar liet Petrobras weten dat SBM Offshore, voor wie Brazilië een belangrijke markt is, voorlopig niet meer naar opdrachten mag meedingen. 'Maar het valt te bezien of Petrobras het zich kan veroorloven om na SBM ook Modec op de zwarte lijst te zetten', aldus Aupers. 'Dit zijn met afstand de twee grootste spelers in dit segment.' Als de beschuldigingen aan het adres van Modec waar zijn, geeft dit volgens Aupers in ieder geval aan dat SBM Offshore niet de uitzondering was binnen de sector. De naam Modec is volgens Valor Economico aan het licht gekomen na onderzoek door een partner van Petrobras, het Britse BG. Dat bedrijf is minderheidsaandeelhouder in enkele Braziliaanse olievelden, waar Petrobras als leidende partij bij betrokken is.

Yes! Dit is het soort nieuws waar ik al tijden op hoop (sorry aandeelhouders Modec). Waar rook is is vuur en in het geval van SBM begon alle narigheid ook met geruchten. Iedereen weet dat smeergeld gemeengoed is (nou, vooruit, was) in Brazilie en dat de concurrentie daar ongetwijfeld aan heeft meegedaan. Dat nu eindelijk een grote rivaal van SBM lijkt te zijn betrapt biedt veel perspectief voor toekomstige opdrachten. Dank, @Bombo, ik ga met een fijn gevoel op vakantie ;-)
Ik ben meestal terughoudend, maar ik voorzie nu toch dat shorters uit moeten gaan stappen. SBM heeft zelf eea aan de kaak gesteld, is daar uitgebreid voor gestraft. Modec mag wel meetenderen.. Volgens de wetten van het gezond verstand moet er nu iets gebeuren. Hopelijk nu op korte termijn concrete actie in Brazilie.
We gaan zien hoe er de komende dagen gereageerd gaat worden in de markt. Lijkt me in ieder geval wel wat procentje waard toch?!

Ja zeg: -55% :-) Artikel uit Valor Economico is nog niet overgenomen door Reuters, Bloomberg, WSJ...tot nu toe.
Bij steeds meer bedrijven die zaken doen met Petrobras komt de corruptie uit. Waarom staat SBM nog op de zwarte lijst terwijl zij open zijn geweest over de corruptie en hier reeds maatregelen voor hebben getroffen. Ik verwacht dat ze nu toch snel van de zwarte lijst gehaald moeten worden. Positief vind ik dat er reeds geschikt is met Nederland en geen vervolging in VS. De kans op een (hoge) boete in Brazilië wordt door dit soort berichten steeds kleiner. De onzekerheid voor concurrenten wordt juist veel groter. Nu SBM al als eerste is gestraft is de strafmaat gezet. De overheid kan denk ik lastig een lagere straf opleggen voor de concurrenten waar de corruptie nu naar buiten komt.
Geen zaken in Brazilië zonder hiervoor af te dragen. Modec staat als leverancier van Petrobras op gelijke hoogte met SBM. Modec heeft 7 FPSO's voor Petrobras gebouwd, en werkt nog aan drie nieuwe. Gelijkaardige tussenkomst ook van de handelsagent van Modec. Hemelsbreed verschil is echter dat SBM sinds 2012 de problematiek van de zelfstandige handelsagenten zelf heeft aangepakt, en met de gevonden informatie naar de autoriteiten en, vooral, naar Petrobras is gestapt. Petrobras speelt overigens de verantwoordelijkheid voor het gebeuren door naar BG, dat hier als operator voor het consortium optrad. In this context, there are frequently meetings for clarification between the consortium and the supply companies.” The acquisition of pre-salt equipment is made by Petrobras, which is the operator for the areas, and is carried out by way of special purpose enterprises (SPE). And the partners vary. Guará BV has as partners PNBV, a Petrobras subsidiary with 45%. BG Overseas Holdings with 30%, and Repsol Sinopec Brasil BV, with 25%, and was responsible for the contracts of the oil rigs Cidade de São Paulo and and Cidade de Caraguatatuba, as Petrobras reported. Another SPE, Tupi BV, has stake in PNBV (65%), BG Overseas (25%) and the Chinese-Portuguese company Galp Sinopec Brazil Services BV (10%), in the cases of Cidade de Mangaratiba and Cidade de Itaguaí. Repsol informed that it is unaware of the subject. This process is led by Petrobras, in the role of operator, with participation from companies of the consortia.” According to the statement from BG Brasil, the company “follows the global standards of Corporate Governance and of Compliance of the Ethical Conduct Policy of the BG Group in all of its activities.” Valor also sought the commercial director of Tecnoil, Andre Somaglino, but received no reply. Until the closing of this edition, Modec hadn’t responded to questions sent by this newspaper.
Ongeveer een jaar geleden had ik een posting met de opmerking dat met het bekend worden van de SBMO handelswijze in Brazilie, SBMO wellicht het eerste bedrijf zou zijn dat schoon schip kon maken en dat er nog wel onderzoeken zouden komen voor de concurrenten. En dat wellicht SBMO concurrentieel voordeel zou kunnen halen door deze situatie, het begint er zowaar op te lijken, maar nu ligt de hele FPSO op zijn gat. In ieder geval is SBMO niet meer het enige zwarte/grijze schaap in de kudde en zijn er nog veel meer donker gekleurde schapen.
