In a blow to its hopes of limiting its legal risk around the Roundup weedkiller, Bayer (OTCPK:BAYRY -1.7%) loses its second appeal of three jury verdicts that found Roundup causes cancer, as a U.S. appeals court refuses to overturn a 2019 $25M judgment and trail verdict in the only case to go to trial in federal court.
The trial judge did not misapply the law when he allowed the lawsuit to go to trial, as Bayer has argued, says a three-judge panel of the 9th U.S. Circuit Court of Appeals in San Francisco.
The decision may embolden consumers to bring more claims beyond the thousands the company is trying to resolve in an $11B settlement.
Bayer is seeking preliminary approval for a proposed $2B settlement to resolve future claims by users who have been exposed to Roundup but have not yet gotten sick.
